Ahmedabad: In a significant legal development, Ahmedabad-based businessman Kapil Sharma has approached the Gujarat High Court alleging unlawful detention and procedural violations by police officials at Sardar Vallabhbhai Patel International Airport.
According to the petition, the incident took place on April 9, 2025, at Sardar Vallabhbhai Patel International Airport, Ahmedabad. Sharma has alleged that he was taken into custody without due process and was not produced before a magistrate within the mandatory 24-hour period. The plea claims he was kept in custody for three days, allegedly in violation of established legal safeguards and the Supreme Court’s D.K. Basu guidelines governing arrest procedures.
The petition names Ajit Rajian DCP Crime and Ram Singh Goyal Investigation officer , accusing them of orchestrating what has been described as an unlawful detention and bypassing statutory requirements.
In his petition, Sharma has further alleged collusion between police authorities and the complainant, Pankaj Prasun, contending that the matter was purely civil in nature. The plea states that two previous closure reports had treated the dispute as civil. However, it alleges that despite this, a fourth inquiry was initiated on the same facts, which the petitioner has termed “malicious” and an abuse of power.
After hearing preliminary arguments, the Gujarat High Court granted interim protection to Kapil Sharma and directed that no coercive action be taken against him, subject to his cooperation with the investigation. The Court also issued notices to the concerned authorities seeking clarification on the legality of the detention. Meanwhile, Sharma has sought departmental action against Ajit Rajian and Ram Singh Goyal over alleged procedural violations.
The matter is now listed for further hearing in March 2026. The High Court is expected to examine whether due legal process was followed and whether the dispute was improperly escalated from civil proceedings to criminal action.
The case is being closely watched, as its outcome may have broader implications for arrest procedures and accountability within law enforcement.
