SC Quashes Case Of Rape On False.Promise Of Marriage

New Delhi: The Supreme Court of India recently quashed a criminal case against an accused-appellant accused of raping a 25-year-old woman, stating that their consensual relationship resulted in marriage.

The Court found no merit in the claim that the physical relationship was based on a false promise of marriage since the marriage was eventually solemnised.

Bench of Justices Abhay S. Oka and Pankaj Mithal noted that the allegations lacked grounds for proceeding against the appellant, emphasising that no prudent person could conclude otherwise.

The case originated from a complaint by the victim’s father, alleging fraud in maintaining a physical relationship. The court considered a notice acknowledging the marriage and the victim’s statement, leading to the quashing of the FIR.
