Transferring the Tuticorin custodial death case to CBI does not require court permission: Madras HC

The Madurai Bench of the Madras High Court has said transferring the Sattankulam father-son duo custodial death case to the CBI does not require its permission. The two men died in judicial custody allegedly due to police torture, creating shockwaves across the nation. When the case came up for hearing today before the Madurai Bench of the Madras High Court, the state Additional Advocate General conveyed the government’s intention to transfer the case to the CBI. The court said it is upto the government to take a call as it comes under its policy domain.

However, the High Court said apparently the Sattankulam Police is not cooperating with the magisterial inquiry that was ordered by the High Court. It asked the Thoothukudi district collector to direct the revenue officials to take control of the police station and to preserve the documents relating to the case.

The High Court has also asked the state forensic officials to visit the local Police Station to gather forensic evidence
