SC Convicts Husband For Murder Of Wife
New Delhi: The Supreme Court of India has confirmed the husband’s conviction in a case involving the murder of his wife and cruelty towards her.
The verdict emphasised the critical role of courts in ensuring justice in cases of crimes against women, urging them to consider practical perspectives and be sensitive.
Justice JB Pardiwala stressed that courts should not allow criminals to escape due to procedural technicalities or insufficient evidence. The court cited the importance of a realistic view of evidence and the rule of reasonable doubt.
The appeal involved a husband’s conviction under sections 302 and 498-A IPC and his mother’s conviction under section 498-A IPC, relating to the murder and cruelty against the wife.
The tragic story involved harassment, dowry demands, and the wife’s suspicious death due to poisoning. The court upheld the convictions based on a strong prosecution case and invoked Section 106 of the Evidence Act, shifting the burden to the accused husband to explain the circumstances of his wife’s death, ultimately dismissing the appeals.
