Court Cannot Destroy Faith & Beliefs of People: Madras HC

The court cannot destroy the beliefs or hopes of the people said Madras High court. The HC dismissed a petition challenging the circular issued by the commissioner of Tamil Nadu Hindu Religious and Charitable Endowment Department to perform Yagnas propagating rain in all important temples under its control

The bench of Justice CV Karthikeyan and Justice Krishnan Ramaswamy in its order makes a reference to the Judgement in Sabarimala Case. It highlights the observations made in the judgement of Deepak Mishra the former CJI that there are no restraints up on the free excersise of the religion. Interestingly Justice Indu Malhotra’s observations in her dissenting opinion have also been widely reproduced in the judgement

The bench remarked that the present petition is an attempt to disturb the faith in the religious belief among the people to bring about the disruption in peace and harmony. It is also observed that normally and consistently the courts have kept away from interfering with the religious practices and beliefs
