It highlights the observations made in the judgement of Deepak Mishra the former CJI that there are no restraints up on the free excersise of the religion. Interestingly Justice Indu Malhotra’s observations in her dissenting opinion have also been widely reproduced in the judgement
The bench remarked that the present petition is an attempt to disturb the faith in the religious belief among the people to bring about the disruption in peace and harmony. It is also observed that normally and consistently the courts have kept away from interfering with the religious practices and beliefs
