Forcing Husband To Leave Parents Amounts To Cruelty:  Delhi HC

New Delhi: The Delhi High Court has recently ruled that wife’s family insisting on her husband  to leave his parents and become a “Ghar Jamai” to live with them, it amounts to cruelty.

The court granted a divorce to a couple who had been living separately, considering it as a case of cruelty and desertion under the Hindu Marriage Act.

The Court emphasised that the denial of conjugal companionship signifies an unsustainable marriage and is a form of extreme cruelty. The appellant-husband claimed mistreatment and lack of marital relationship due to pressure from his wife’s family to live as a “Ghar Jamai.”

The court referred to a Supreme Court decision stating that asking a son to separate from his parents is cruelty. The husband’s appeal was upheld as the court found the wife’s allegations unproven and her false complaint amounted to cruelty.

The court also acknowledged the husband’s relationship with another person but stressed that the wife had withdrawn from the marriage without a substantial reason. The court appreciated a senior advocate’s generosity in supporting the financially struggling family.
